RISK WARNING ON DIGITAL PAYMENT TOKEN SERVICES

The Monetary Authority of Singapore (MAS) requires us to provide this risk warning to you as a customer of a digital payment token (DPT) service provider.

Before you:

(a) pay your DPT service provider any money or DPT; or
(b) pay a third party any money or DPT under an arrangement by your DPT service provider, you should be aware of the following.

1. 1. Your DPT service provider is licensed by MAS to provide DPT services. Please note that this does not mean you will be able to recover all the money or DPTs you paid to your DPT service provider or any other third party referred to above, if your DPT service provider’s or the third party’s business fails.

1A. You should be aware that MAS does not supervise or regulate your DPT service provider for the provision of unregulated services. This includes any service of trading digital payment token derivatives such as futures.

2. You should not transact in the DPT if you are not familiar with this DPT. This includes how the DPT is created, and how the DPT you intend to transact is transferred or held by your DPT service provider.

3. You should be aware that the value of DPTs may fluctuate greatly. You should buy DPTs only if you are prepared to accept the risk of losing all of the money you put into such tokens.

4. You should be aware that your DPT service provider, as part of its licence to provide DPT services, may offer services related to DPTs which are promoted as having a stable value, commonly known as “stablecoin”.

1 Privacy and Regulatory Compliance Statement

1.1 Privacy Collection Statement

 

HashKey Technology Services Pte. Ltd. shall collect personal information in this account-opening application in order to establish your identity, assess your application for the products and services we offer and provide you with the products and services.
 

-We use and disclose your personal information in accordance with our Privacy Policy and Complaint Handling Policy

-The Privacy Policy and laws and regulations, including Compliance Handling Policy contain information about how you may complain about a breach of your privacy and a breach of the Personal Data Protection Act 2012 ("PDPA") and how we will deal with the situation in the event of such a complaint.

-We are required to collect your personal information in this application to comply with anti-money laundering (AML) and countering the financing of terrorism (CFT) laws and regulations, including the Monetary Authority of Singapore Act (Cap. 186) and Corruption, Drug Trafficking and Other Serious Crimes (Confiscation of Benefits) Act (“CDSA”).

-Collection of your personal information is necessary both to provide you with the requested products or services and to enable us to comply with mandatory AML/CFT requirements under the MAS Act and related regulations. Failure to provide such data may result in our inability to open or maintain your account.

-We may disclose your personal information to third parties identified in our Privacy Policy.- For operational, compliance and onboarding purposes, we may share your personal information within our Group, including with its affiliates located in Hong Kong, Singapore and other jurisdictions, to perform client identity verification, compliance review, account onboarding, and the provision of related products and services.

-Any such cross-border transfers will be undertaken only to the extent lawful and necessary, and will be subject to applicable data-protection laws (including but not limited to the PDPA, Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong, and other relevant data-protection regimes) as well as contractual or technical safeguards to ensure confidentiality and security.

 

1.2 Declarations

By signing below, you agree and declare that:

-all information, documents and/or records (including electronic records) provided by you to HashKey Technology Services Pte. Ltd., are true, accurate and complete;

-You have read the Privacy Collection Statement and you have read the Privacy Policy and Complaint Handling Policy; and

-You will notify HashKey Technology Services Pte. Ltd. of any change to the information provided in this application and acknowledge that you are required to update KYC and related details on an ongoing basis in order to comply with applicable AML/CFT obligations.

 

2 Retail Client Acknowledgements

By signing below, you, as a retail client, acknowledge and agree that:

-You must successfully complete our Risk Awareness Assessment before you can access our DPT services.

-We are prohibited from and will not offer you any credit, leverage, or margin facilities to trade DPTs, nor will we accept payments via credit cards for DPT purchases.

-We are prohibited from offering you any incentives or promotions to trade DPTs, and you confirm that you have not been offered any such inducements to open this account.

 

3 Nature of Our Services

By signing below, you acknowledge that:

-No Advice: We provide execution-only services and do not provide any financial, investment, legal, or tax advice. All transactions are undertaken on your sole judgment.

-Principal Trading: We may act as principal in transactions with you. This means we are on the other side of your trade and may earn a spread or mark-up on the price, creating a potential conflict of interest. We do not owe you a duty of best execution unless expressly stated otherwise in our terms.

 

4 Responsibility for Wallet Addresses and Blockchain Risks

By signing below, you represent that you have sole control of any wallet address you provide to us. You acknowledge that blockchain transactions are irreversible. We are not liable for any losses incurred due to you providing incorrect or incompatible wallet addresses or network information. You acknowledge the inherent risks of blockchain networks, including but not limited to, forks, network congestion, and 51% attacks, which may impact our services.

 

5 Acknowledgement

By signing below, you agree and acknowledge that:

-it is an offence to provide false or misleading information, including false, misleading or forged documents;

-HashKey Technology Services Pte. Ltd. may freeze your account or any payment from or to the account, where

-we are obliged to do so by law or regulatory requirements or for the purpose of prevention or detection of unlawful activities,and you agree:

-to be bound by the Master Service Agreement and Terms for the account in this application;

-to check the transaction records on the statements of your account and notify HashKey Technology Services Pte. Ltd. immediately upon detection of any errors, unauthorized transactions or unusual transactions.

-You confirm that you have either received the following documents or you have read these documents on our website.

-Terms -Privacy Policy -Compliant Handling Policy

You expressly acknowledge and agree that: (a) Digital Payment Tokens are not legal tender or currency in Singapore. (b) The Digital Payment Tokens and services provided to you are not protected under the Deposit Insurance and Policy Owners’ Protection Schemes Act 2011. 

Consent to verify personal information electronically

HashKey Technology Services Pte. Ltd. will use third party service providers to verify all customer identities against those on the database of the government organization which issued the document. Please read this carefully before you tick the box below to confirm your consent.

[ ] You give your consent for HashKey Technology Services Pte. Ltd. to disclose and use your personal information such as your name, date of birth and credential information on an identity document in order to access and use the information matching to assist in verifying and confirming your identity for the purposes of anti-money laundering (AML) and countering the financing of terrorism (CFT) pursuant to Monetary Authority of Singapore Act (Cap. 186) and Corruption, Drug Trafficking and Other Serious Crimes (Confiscation of Benefits) Act (“CDSA”). You acknowledge that you are authorised to provide the information provided and HashKey Technology Services Pte. Ltd. may use a third-party gateway service provider to access and use the match result. You acknowledge and agree that this consent applies until we have received a written notification from you that this consent is cancelled.
